Fit-Ear Warranty

 

Please read this warranty page in full. There are customer obligations required for warranty work, repairs or issues with fit and each product has special warranty requirements. 

A fit issue caused by the installation of a helmet does not constitute a condition of: Not as Described or a Defective Merchandise issue. 

Due to the custom nature of the products, there are no refunds or credits issued under any condition. Please see the Terms of Sale at the bottom of this document.

 

Warranty / Repair
Custom Fit, Budget, Solid Ear Plugs

All fit issues must be corrected within the first 30 days from delivery. Fit-Ear, warrants the Budget ear plugs, made on site, to fit and be free from defects in materials and workmanship for one (1) year from date of purchase. Fit-Ear’s sole obligation under this limited liability warranty shall be to repair or replace your product. Fit-Ear will re-coat, repair or remake this product for the original customer for the limited liability warranty period, if found to be required, to resolve the issue.

Fit-Ear products are not meant to block out all sound, but to provide limited noise protection from loud environments and still allow a person to communicate, depending on the hearing loss of an individual.  With a properly fit, made on-site Budget ear plug, the attenuation should reach approximately 25-32 decibels.

This limited liability warranty provides the original purchaser with specific legal rights, which may vary from state to state or country to country.

Due to the custom nature of the products, there are no refunds or credits issued under any condition.

 

Warranty / Repair
Custom Fit, Premium, Solid Ear Plugs

All fit issues must be corrected within the first 30 days from delivery. Fit-Ear warrants the Premium ear plugs, made on site, to fit and be free from defects in materials and workmanship for three (3) years from date of purchase. Fit-Ear’s sole obligation under this limited liability warranty shall be to repair or replace your product. Fit-Ear will re-coat, repair or remake this product for the original customer for the limited liability warranty period, if found to be required, to resolve the issue.

Fit-Ear products are not meant to block out all sound, but to provide limited noise protection from loud environments and still allow a person to communicate, depending on the hearing loss of an individual.  With a properly fit, made on-site Premium ear plug, the attenuation should reach approximately 27-32 decibels.

This limited liability warranty provides the original purchaser with specific legal rights, which may vary from state to state or country to country.

Warranty / Repair
Custom Fit, Make On-Site, Stereo Plugs

All fit issues must be corrected within the first 30 days of delivery. Fit-Ear warrants all custom fit, Make On-Site Stereo ear products to be free from defects for a period of  thirty (30) days from date of delivery, subject to the “Users Obligations” listed below.  Any Fit-Ear product that is returned after the firsts (30) day period, and after the Fit-Ear examination, shows that the product has a defect in materials or workmanship, during the thirty (30) day limited liability warranty period, may be repaired at no cost to the customer. If damage to the custom ear shell, components or cord are beyond repair, the customer has been advised that the Make On-Site product can be remade into a lab product for an additional charge. A mold to perform this modification is required and any cost incurred, is the sole responsibility of the customer.

Fit-Ear’s sole obligation under this limited liability warranty shall be to repair your product, if the product is repairable. 

Fit-Ear products are not meant to block out all sound, but to provide limited noise protection from loud environments and still allow a person to communicate, with limited or reduced sound on a source, depending on the hearing loss of an individual.  With a proper fit, custom Made On-Site Stereo ear plugs, the product should attenuate approximately 21-32 decibels, depending on the product.

This limited liability warranty provides the original purchaser with specific legal rights, which may vary from state to state or country to country.

Due to the custom nature of the products, there are no refunds or credits issued under any condition.

 

Warranty / Repair
Custom Fit, Electronic, Ear Products

All fit issues must be corrected in the first thirty (30) days of delivery. Fit-Ear warrants all electronic products to be free from defects for a period of twenty four (24) months from date of shipping subject to the “Users Obligations” listed below. Fit-Ear’s sole obligation under this warranty shall be to repair or replace your product. 

Fit-Ear products are not meant to block out all sound, but to provide limited noise protection from loud environments and still allow a person to communicate, depending on the hearing loss of an individual.  With a proper fit, custom fit on-site solid ear plugs should attenuate approximately 15-34 decibels.

This limited liability warranty provides the original purchaser with specific legal rights, which may vary from state to state or country to country.

Warranty / Repair
Non-Custom, Electronic, Non- Electronic, Products

Fit-Ear warrants all Non-Custom electronic, Non- Custom, Non-Electronic products to be free from defects for a period of not less than thirty (30) days or more than twelve (12) months from date of purchase or shipping. Which ever is later in date. This warranty is also subject to the “Users Obligations” listed below. Fit-Ear’s sole obligation under this warranty shall be to repair or replace your product, if the product is found to have or be a manufacturers defect.

Warranty / Repair
Users’ Obligations For All Fit-Ear Products

Fit-Ear products are manufactured from a mold of the natural ears while holding a bite block in the mouth to provide maximum seal from outside sound. This process is done to correct many types of disorders and jaw motions, including talking or chewing gum.  This process is not performed to increase comfort of the product when in use under a helmet. Being that the mold is taken of the natural ear, pressure and discomfort may arise from an under helmet application.  If a fit issue is caused by the installation of a helmet over the product, this does not imply that the product is defective or has been mis-represented.  Most helmets can be tuned to accomodate the use of custom products.

1.  The largest problem is the customer’s inability to manage earwax. Most problems are usually from earwax blocking the sound bore in the electronic device.  It is up to each customer to keep earwax managed. Doing this, most problems will be avoided. Many products are available to help you manage ear wax at any pharmacy or on our website. See cleaning and care insert enclosed with your electronic product purchased.

2.  Fit-Ear is in regular attendance at trade shows and events, and depending on your problem, limited liability warranty fit adjustment are to be made by one of our trained ear mold impressionists.  All Fit issues must be corrected within the first 30 days from delivery.

3.  It will be up to the customer to contact Fit-Ear about a fit issue and any expense to resolve a fit issue or problem, is soly the responsibility of the customer. After the customer’s initial contact with Fit-Ear about a fit issue, the customer will need to print and fill out the repair invoice. Have a correction mold made, if required  and send the repair invoice, legible copy of the origional invoice, origional product and correction mold back to Fit-Ear for any repairs to be performed. If the customer is unable to have a correction mold made, the possibility may occure for the customer to attend another event, to have any matter or issue corrected. If the customer is instructed to do so by Fit-Ear. Accordingly, Fit-Ear will assist a customer in finding an event, nearest to your location, where a correction mold can be made or  service can be provided and such limited liability warranty work as authorized, can be performed.

4.  Any Limited Liability Warranty work, as appropriate, must be sent directly to Fit-Ear, freight prepaid, at the address below and must include a completed repair Invoice form, describing the problem, along with return address information for the product to be returned and any additional shipping instructions.

5.  No limited liability warranty work will be provided for damage caused by the user, such as, but not limited to, impacted ear wax in the filter, over driving of the transducer (s) (caused by having the volume turned up when you plug in your Fit-Ears), damage caused by impact shock, extremes of temperature, immersion in any liquid, abuse, or any other customer caused damage.

6.  All Limited Liability Warranty work shall be provided for the original purchaser only and ledgible copy of the origional invoice, or proof of purchase is required for any and all Limited Liability Warranty work.

7.  Limited Liability Warranty work is performed by trained professionals either on-site or in our lab and is precise, methodical and complete. No additional authorization is required.  Accordingly, please be aware that, depending on the problem, it could take up to six (6) weeks to complete the work and return it to you.

8.  If any Fit-Ear product is returned after the (30) day period, and if Fit-Ear’s examination shows that the product has a defect in materials or workmanship during the limited liability warranty period, it may be repaired at no cost to the original customer.

9.  In the event that our examination finds the damage not subject to our Limited Liability Warranty Fit- Ear will provide a quote to make any repairs to filters, transducers, cables, etc. Such repair work will only be done upon the customer’s acceptance, authorization and payment.

10.  If a customer chooses not repair a product and does not provide information, authorization or funding for a term of thirty (30) days, from repair authorization contact from Fit-Ear, the product, materials and warranty are subject to a “NO FURTHER INTERST STATUS” and may be discarded, without further notice to the customer.

Fit-Ear TERMS OF SALE
These Terms of Sale (these “Terms of Sale”) govern the purchase of products or services
(collectively “Products”) from Fit- Ear using the Fit-Ear online store (the “Store”). Please read these Terms
of Sale carefully. BY USING THE STORE, YOU AGREE TO THESE TERMS OF SALE; IF YOU DO NOT
AGREE, DO NOT USE THE STORE.
U.S. SALES ONLY
Purchases of Products from the Store are available only in the United States of America and are not
available in any other location. You agree not to use or attempt to use the service from outside of the such
locations. Fit-Ear may use security technologies to verify your purchase is occurring within the
United States of America.
SALES TO END USERS ONLY
The Store sells Products to end user customers only.
AGE REQUIREMENTS.
The Store is available for individuals aged 18 years or older. If you are under the age of 18, you should
review these terms and conditions with your parent or guardian.
PRODUCTS
You acknowledge that use of Products may require the use of other hardware products (e.g., the ability to
hear music on the Products requires a compatible audio player device), and that such hardware is your
responsibility. Once a Product is purchased and you receive the Product, it is your responsibility not to
lose, destroy, or damage the Product, and Fit-Ear shall be without liability to you in the event of any loss,
destruction, or damage. Prices and availability of any Products are subject to change at any time.
WARRANTY AND REFUND POLICY

INFORMATION
You agree to provide accurate, current, and complete information required to process your order with the
Store and at other points as may be required in the course of using the Store (“Registration Data”). You
further agree to maintain and update your Registration Data as required to keep it accurate, current, and
complete. Fit-Ear may terminate your rights to any or all of the Store if any information you provide is false,
inaccurate or incomplete. Neither UE nor UE’s credit processing agent, Merchant Processing keeps record
of your credit card account information and while being used it is safe and secure.
PAYMENT METHODS
The Store accepts the credit cards listed below as payment for Products. Fit-Ear may obtain a pre-approval
from such credit card company for an amount up to the amount of the order. [Billing to your credit card occurs

unable to accept credit cards issued by banks outside of the United States of America. Debit cards and check

Warranty
If a purchase has been declined online due to credit card issues, please ensure all data is correct
and resubmit. If the transaction is not accepted online, you will be unable to use that card for your
purchase and should use another credit card.
If you use the shopping cart functionality, you will have one order that authorizes and bills as a
single purchase.
SALES TAX
Store purchases will include sales tax based on the bill-to address and the sales tax rate in effect at
the time of order. No customers are eligible for tax exemptions for purchases made on the Store.

All sales on the Store are governed by California law, without giving effect to its conflict of law
provisions. You agree to comply with all local, state, federal, and national laws, statutes, ordinances,
and regulations that apply to your use of the Store. THE USE OF THE STORE, EXCEPT AS
PERMITTED IN THESE TERMS OF SALE, IS STRICTLY PROHIBITED.
No Fit-Ear employee or agent has the authority to vary any of the Store’s policies or the terms and
